Terms of Service

These Terms of Service ("Terms") govern your use of FindPreset (the "Service"), operated by Ing. Radek Svoboda, an individual entrepreneur (OSVČ) registered in the Czech Republic, IČO 02393131, DIČ CZ9307155099, with registered address Slovanská 1870, 684 01 Slavkov u Brna, Czech Republic ("we", "us", "our").

By accessing or using the Service, you agree to these Terms.

1. The Service

FindPreset provides software that analyzes uploaded photographs and produces Adobe Lightroom preset files (.xmp) approximating the visual editing settings of the analyzed photograph. Two extraction modes are offered:

  • EXIF mode — free for all users; reads camera metadata embedded in photos.
  • AI mode — uses Anthropic Claude AI to analyze images and generate settings. Available under a paid subscription with a limited number of free credits for new accounts.

You acknowledge that AI-generated outputs are approximations, not exact reproductions, and that results may vary depending on input image quality. We do not guarantee that any preset will produce a specific visual result on your own photos.

2. Accounts

Browsing the Service and using EXIF mode does not require an account. AI mode requires a free account, created via Clerk (our authentication provider). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3. Subscription and billing

Paid plans are sold through LemonSqueezy (Lemon Squeezy Inc., USA), which acts as the merchant of record for the transaction. By subscribing you enter into a transactional contract with LemonSqueezy, who collects payment, calculates and remits applicable taxes, and issues receipts. LemonSqueezy's Terms of Service govern the subscription transaction itself.

Your subscription:

  • Renews monthly until you cancel.
  • May be cancelled at any time via your account page or by contacting support.
  • Cancellation takes effect at the end of the current billing period.

4. Credits

AI extractions consume credits. Each free signup grants 3 bonus credits, which do not expire. Paid subscriptions include a monthly extraction allowance that resets at the start of each billing period and does not roll over to the next.

We reserve the right to adjust credit allowances, pricing, or the AI model used for processing, with at least 30 days' notice to active subscribers.

5. Acceptable use

You may not upload images:

  • that you do not have the right to use or distribute;
  • containing illegal content, including child sexual abuse material;
  • containing personal data of identifiable individuals without their consent;
  • uploaded for the purpose of circumventing the Service's intended use, including automated abuse or attempts to overwhelm our infrastructure.

We may suspend or terminate accounts that violate these rules without prior notice.

6. Intellectual property

You retain all rights to images you upload. By uploading an image, you grant us a limited, non-exclusive, worldwide license to process it through our pipeline (including transmission to Anthropic for AI analysis) solely for the purpose of providing the Service to you.

Generated preset files (.xmp) are yours to use, share, or modify without restriction. We claim no rights in them.

Our software, branding, documentation, and the Service itself are protected by copyright and remain our property.

7. AI processing

When you use AI mode, your image is transmitted to Anthropic, PBC (USA) for processing via the Claude API. Anthropic states that they do not train models on customer API inputs and do not retain inputs beyond limited abuse-detection windows. Images are not retained by us beyond the processing session, except as described in our Privacy Policy.

You acknowledge that you are interacting with an automated AI system. Outputs are generated by a machine and may contain inaccuracies, omissions, or unexpected results.

8. Limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by Czech law.

To the maximum extent permitted by law, we exclude liability for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total cumulative liability for any claim arising from these Terms or the Service is capped at the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under Czech law, including liability for damages caused intentionally or by gross negligence (§ 2898 of the Czech Civil Code).

9. Governing law and disputes

These Terms are governed by the law of the Czech Republic. Any dispute arising from or related to these Terms will be resolved by the competent courts of the Czech Republic.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to subscribers or by a notice in the Service at least 30 days before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance.
